    ToR for Anti-Harassment Policy Development Consultant

    Background

    The Society of Ex-Budhanilkantha School Students (SEBS) is a membership organization for the school’s alumni. Formed in 1982, SEBS aims to increase cooperation and unity between alumni and develop their creative and leadership capacity. In addition, it seeks to provide social service to the community of Nepal and help in its development.

    The alumni population is representative of the diversity of caste/ethnicity, geography, sexual orientation, and political leanings of the people of Nepal. Furthermore, the school started admitting women 11 years after its establishment and has a strong female alumni base as well. Given that SEBS serves alumni across 41 batches, there is generational diversity as well.

    As an alumni organization, SEBS engages its membership through formal events such as annual gatherings, call for volunteering for social causes, as well as informally connecting alumni with each other for work, college applications, and other relevant causes. In general, the alumni are a close knit community. They interact frequently and across all channels (online, in-person, over the phone).

    The organization seeks to create a safe, respectful, and dignified environment where alums from all backgrounds feel welcome. SEBS strives to connect its members with each other and ensure that all members feel comfortable to participate in its activities and interact with each other. The organization recognizes that there are challenges to creating and maintaining a welcoming environment for all. There have been incidents of harassment in the past which have been reported directly to the executive committee and we are also aware of unreported incidents.

    In response to these incidents and with the intention of addressing and preventing such incidents in the future, the current SEBS executive committee has decided to formulate an anti-harassment policy. Therefore, a standing committee was formed to develop the anti-harassment policy. The committee seeks to deeply examine the issue of harassment and come up with a robust policy that can guide our membership.

    Assignment

    The standing committee has been given the authority to hire a consultant for the task of developing an anti-harassment policy. The consultant will work closely with the standing committee to draft the SEBS anti-harassment policy as well as implementation tools and provide recommendation for dissemination of this policy. The consultant will carry out the background work necessary to create the policy document. We envision the policy to be placed within the Nepali legal context and be enforceable by a membership organization such as SEBS. The committee seeks to develop an anti-harassment policy that covers all forms of harassment—verbal, physical, sexual, bullying and retaliation whether it is done in person or online.

    Scope of Work

    The consultant’s main responsibility is to draft the SEBS anti-harassment policy. The consultant is expected to carry out the necessary background work to draft the policy. The background work shall include but is not limited to the following activities:

    ? Conduct a desk review of relevant literature including relevant laws in Nepal, anti-harassment policies in the workplace, anti-harassment policies of membership organizations both in Nepal and elsewhere, and any other relevant documents.
    ? Supplement the above review with relevant international best practices
    ? Interview key informants
    ? Carry out focus group discussions
    ? Analyze data collected from the interviews and focus group discussions to inform policy document
    ? Draft anti-harassment policy document, including one-page executive summary
    ? Draft policy dissemination strategy
    ? Draft tools for implementing the anti-harassment policy, including incident reporting forms, protocols, etc as required
    ? Provide further recommendations that can aid SEBS in creating a safe environment for its membership to participate in its activities
    ? Proactively consult with team members and other stakeholders as required to complete the above tasks

    The scope of work will be finalized in coordination with the consultant and the Standing Committee. The committee will share relevant literature in our disposition, and assist with logistical coordination for key informant interviews and focus group discussions.

    Deliverables

    The deliverables for this assignment will be as follows:

    1. Final Scope of Work
    2. Anti-harassment policy document
    3. Tools for implementing the policy such as incident reporting forms and protocols
    4. Recommendations for dissemination of policy

    Timeline and Payment

    The duration of the contract will be valid from the date of signing the contract until December 31, 2018. In consultation with the selected consultant, additional tasks and days may be added later depending on the finalised Scope of Works. The consultant will have to provide for their own communication and transportation expenses. Payment for days worked will be conditional on satisfactory fulfilment of the conditions and provision of deliverables as described above. Interested applicants should indicate an all-inclusive professional service fees for the assignment in terms of level of effort required (Number of Days * Daily Professional Rate), including Value Added Tax if applicable. Tax Deductions at Source will be made as required by prevailing laws.

    Applications should include:

    1. A Technical Proposal including:
    a. A cover letter
    b. Curriculum Vitae (of all key team members in the case of institutional applicants), demonstrating prior assignments of similar nature
    c. A short description of proposed methodology (maximum 800 words)
    d. Academic Certificates (in the case of individual applicants)
    e. Registration and Tax Documents (in the case of institutional applicants)
    f. Contact information for two references

    2. An all-inclusive professional service fees for the assignment in terms of level of effort required (Number of Days * Daily Professional Rate), including Value Added Tax if applicable.

    The standing committee will make a determination based on the experience and expertise of the applicant and the fee quoted. The standing committee has the discretion to select any of the applicant, enter into negotiations or cancel the RFP if it deems necessary.

    Line of reporting

    The consultant will report to the SEBS Committee on Anti-Harassment Policy Coordinator, Jui Shrestha and copy relevant communications to other team members.
